The question is rarely whether ice was dangerous. It is whether the property owner had a fair chance to deal with it and failed to act reasonably.
Property owners generally have a duty to take reasonable measures to clear snow and ice from walkways and lots. Reasonable is the key word. They are not required to keep every surface perfectly clear at every moment during a storm.
What counts as reasonable depends on the circumstances: how much snow fell, how long ago, the type of property, and how much foot traffic it sees.
Courts often recognize that an owner should have a reasonable amount of time after precipitation stops to clear hazards. Falling during an active storm, or right as it ends, is generally harder to build a claim around than falling well after the weather cleared.
That is why the timeline of the storm, when it started, when it ended, and when you fell, becomes central to the case.
There is an important difference between fresh storm ice and ice created by a property's own problems. Ice that forms because a downspout drains across a walkway, a gutter leaks, or melting snow refreezes in a known trouble spot can point to negligence independent of the storm.
These recurring or man-made conditions are often the strongest snow-and-ice claims, because they show a hazard the owner had ongoing reason to address.
