Of all the ways a valid claim can fall apart, the most avoidable is also the most final: running out of time. The law sets a firm outer limit for filing a lawsuit, called the statute of limitations, and once it passes, even an ironclad case is generally lost.

The standard deadlines

For most personal injury claims, the general filing windows are:

New Jersey - generally two years from the date of the accident or injury.

The 90-day trap: claims against the government

When your injury involves a public entity - a city bus, a municipal vehicle, a hazard on public property - a separate and much shorter clock starts. Both states require you to file a formal notice of claim well before any lawsuit, often within 90 days of the incident.

Miss that notice window and you can lose the right to sue even though the two- or three-year period has barely begun. Because it is so easy to overlook, government-related injuries are among the most time-sensitive claims there are.

When the clock can shift

The 'date of the accident' is not always the starting point. In limited circumstances the deadline can be paused or extended - for example, when the injured person is a minor, or when an injury was not reasonably discoverable right away.

These exceptions are narrow and heavily fact-specific. They are a reason to have your timeline reviewed, not a reason to assume you have more time than the standard rule suggests.

No-fault and insurance deadlines run even sooner

Separate from the lawsuit deadline, your own insurance benefits carry their own tight windows. No-fault and PIP applications often must be submitted within weeks of a crash, and failing to report promptly can jeopardize the coverage that pays your early medical bills.

In other words, 'you have two years' is only part of the story. Several shorter clocks may already be running the day after your accident.
